This Terms of Service and Privacy Notice governs your access to and use of the Insight platform. Please read it carefully. By clicking “I Accept” you confirm that you have read, understood, and agree to be bound by these terms, and that you consent to the processing of your personal information as described below.
Insight is an audit and compliance platform operated by Asimotech (“we”, “us”, “our”), with registered office at 228 Jochem St, Rietvalleirand, Pretoria, 0174, Republic of South Africa. Asimotech is the responsible party for the processing of your personal information under the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) (“POPIA”).

To use Insight you must be at least 18 years old and authorised by your employer or principal to access the platform on their behalf. Your account is personal to you. You are responsible for keeping your password confidential and for all activity carried out under your account.
You must provide accurate registration information and keep it current. We may suspend or close accounts that contain false information or that are used in breach of these terms.
You and your organisation retain ownership of all data you upload to, or create within, Insight (“Customer Data”). We process Customer Data on your behalf strictly to provide the service. We do not sell Customer Data, and we do not use it to train external models.
You are responsible for ensuring you have the legal right to upload any personal information about third parties (for example, your employees, clients, or contractors) and for informing those people that their information is processed in Insight.

We rely on the following lawful bases under POPIA, depending on the processing activity: (a) your consent, given when you accept these terms; (b) performance of a contract with you or with your organisation; and (c) our legitimate interests in operating a secure and reliable platform, balanced against your rights.

We do not sell, rent, or share your personal information with third parties for their own marketing purposes.
Insight is hosted in South Africa. If your data is transferred outside the Republic of South Africa, we ensure that the recipient is subject to laws, binding corporate rules, or contractual provisions that provide a level of protection substantially similar to POPIA, as required by section 72 of POPIA.
We retain your personal information for as long as your account is active. After your account is closed we retain audit-trail records (for example, who completed which audit, signed off which finding, or accepted which version of these terms) for the period required by applicable laws and regulations governing audit and compliance evidence, and for the period reasonably necessary to defend or pursue legal claims. Customer Data uploaded by your organisation is retained according to your organisation’s contract with us.
We apply reasonable technical and organisational measures to protect personal information from loss, unauthorised access, alteration, or disclosure. This includes encrypted transport (HTTPS), hashed password storage, role-based access controls, server-side logging, and routine backups. No system is perfectly secure; you should also keep your credentials safe and report any suspected compromise to us.

If you are not satisfied with how we have handled your personal information, you may complain to the Information Regulator at JD House, 27 Stiemens Street, Braamfontein, Johannesburg, 2001, or by email at complaints.IR@justice.gov.za.
Certain personal information, such as your name, email address, and organisational affiliation, is required to create and maintain your account. If you choose not to provide this information, or if you withdraw your consent to its processing, we will be unable to provide you with access to the Insight platform. Where information is optional (for example, a profile picture), this is indicated in the platform interface, and choosing not to provide it will not affect your ability to use the service.
Insight uses your browser’s local storage to keep you signed in and to remember preferences such as your theme. We do not use third-party advertising cookies. If you clear local storage you will be signed out.
You agree not to: (a) attempt to gain unauthorised access to any part of the platform, other accounts, or our infrastructure; (b) interfere with or disrupt the service; (c) upload content that is unlawful, infringes third-party rights, or contains malware; (d) use the platform to harass, defame, or unlawfully discriminate against any person; or (e) use the platform in a way that contravenes any applicable law.
You may, through your use of Insight, gain access to information that is confidential to your organisation, your customers, or third parties. You agree to treat such information as confidential and not to disclose or use it other than for the purposes for which access was granted.
All rights, title, and interest in the Insight software, the user interface, the database schema, our trade marks, and our documentation remain with Asimotech. Nothing in these terms transfers any intellectual property rights to you, other than a limited, revocable licence to use the service in accordance with these terms.
We work hard to keep Insight available, but we do not warrant uninterrupted access. The service is provided “as is” without warranties of any kind, except those that cannot be excluded under applicable law. We may schedule maintenance and will give reasonable notice where practical.
To the maximum extent permitted by law, Asimotech’s aggregate liability to you arising out of or in connection with these terms or your use of the platform is limited to the fees paid by your organisation for the platform in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential losses.
By signing up and logging into Insight, you acknowledge and agree that you provide your personal information voluntarily and that such information will be processed in accordance with applicable data protection laws, including POPIA, and the terms of this notice. To the fullest extent permitted by law, you indemnify and hold harmless Asimotech, its directors, employees, agents, contractors, and service providers from and against any loss, damage, claim, liability, cost, or expense arising from or relating to:
You may stop using Insight at any time. We may suspend or terminate your access if you breach these terms, if your organisation’s contract with us ends, or if we are required to do so by law. On termination, sections relating to your data, confidentiality, intellectual property, limitation of liability, and indemnity survive.
We may update these terms from time to time. When we do, we will publish a new version with a summary of the material changes. The next time you sign in you will be asked to read and accept the updated terms before you can continue using Insight. The current version is shown at the top of this page.
These terms are governed by the laws of the Republic of South Africa. You and Asimotech submit to the non-exclusive jurisdiction of the South African courts for any dispute arising out of or in connection with these terms.
